Diversion Programs Process

Agreeing on terms. Next, the prosecution and the DUI defense team negotiate the terms of the diversion program. These can include requiring that the defendant perform community service, not commit any addition crimes, and/or attend rehabilitation courses.

Following through. If the defendant succeeds in following the terms of the program for the specified time period, the charges will be dismissed. If not, the suspended sentence reactivates and becomes effective immediately.
